PURCHASE PRICE:
Price being offered for the property.
DEPOSIT:
A deposit is usually submitted along with an offer to demonstrate the Buyer's good faith and will be applied against the purchase price of the home on closing. It is normally in form of a cheque, made out the the Listing Realtor Brokerage Firm and is held in trust until the deal is completed.
COMPLETION DATE:
The date that the Buyers will take possession of the house in other words the day that the title of the property gets transferred to the buyer and that the funds get disbursed to the seller.
IRREVOCABILITY OF THE OFFER:
The date & time that this offer is valid until - often till end of day by midnight.
INCLUSIONS & EXCLUSIONS:
Chattels & Fixtures that the Buyers would like to have included or excluded in the purchase price. Typically appliances are included but not always. Other inclusions may be Garage Door Opener & Remotes, Central Vac & all the Attachments, Electric Light Fixtures, Blinds & Window Coverings, etc.
Note: Chattels are usually considered excluded and fixtures are normally considered included unless stated otherwise.
An easy way to differentiate between Chattels and Fixtures is the following: if you imagine the house being the size of a doll house - if you were to take it, turn it upside down and shake it, all the items that would fall out are referred to as chattels and all the items that stay attached would be referred to as fixtures (ie fixed to the house such as light fixtures, shelves, etc.)
TIME TO EXAMINE TITLE:
"Title" is the legal evidence of ownership, and the buyer will want to be sure a lawyer has time to confirm that your ownership is free of restrictions.
CONDITIONS:
Conditions are put in to protect the buyer - common ones are "conditional on home inspection" or "subject to the buyer obtaining financing" or "conditional on the sale of the Buyer's property."
In the case of a condominium corporation -it is common to have such offer conditional on the Buyer's lawyer reviewing the condominium corporation documents and finding them satisfactory.
Other specific clauses may be included relating to pools or country properties.
